An Owerri Based legal practioner Collins Iwuorie Esq of Iwuorie & Iwuorie legal firm has filed a legal action against the state Governor Senator Hope Uzodinma for Appointing himself Commissioner for lands, survey and physical planning Imo State.
In a suit No HOW/587/2024 before Justice Vin Onyeka of Imo State High court, the plaintiff Collins Iwuorie Esq in a relief is asking the Honourable court declear it as illegal Governor Uzodinma’s action of Appointing himself Commissioner for lands, survey and physical planning because it is violates section 183, 193( 2) and193 of the Constitution of Federal Republic of Nigeria, 1999 as amended which made it clear that a Governor shall not during the period when holds Office, hold any other Executive office or paid employment in any capacity whatsoever.
And also for One to be appointed Commissioner, his or her Name should be forwarded to the state House of Assembly for purposes of confirmation.
The radical lawyer is therefore praying for the Honourable court to upon the determination of the case on merit give an order nullifying Governor Uzodinma appointment of himself as Commissioner for lands, survey and physical planning being invalid, null and void contrary to section 183 and 192(2) and (5) of Constitution of the Federal Republic of Nigeria, 1999 as amended.
Also an order restraining the Governor.from parading himself/performing the functions of the office of the commissioner for lands, survey and. Physical planning while he holds Office as the Governor.
And as well issue an. Order directing the Governor to appoint any qualified person of his choice as Commissioner who should be screened by Imo State House of Assembly for the purposes of confirmation in accordance with section 192(2) of the Constitution of Federal Republic of Nigeria.
Also joined in the suit are the Attorney General and Commissioner for Justice and Imo State House of Assembly.
